This report is drawn up on the basis of data collected from “LGBT Youth Organization Action” data on hate crimes targeting the LGBTI people in Bulgaria. Data were collected from May to October 2017 by questionnaire for the injured parties and witnesses, distributed online through the communication channels of the organization. In addition to the questionnaires, the representatives of the “LGBT Youth Organization Action” held a number of meetings with individual victims and witnesses of crime, with the LGBTI community, representatives of non-governmental sector, police, Prosecutor’s Office , judges and citizens. okladt has several main goals. First, since the national law does not recognize the crimes based on hatred of LGBTI and, therefore, National Statistical Institute cannot collect information about such crimes, the report will begin regular reporting procedure that will LGBTI community motivated to report crimes. The second objective of the project is to provide knowledge of all potential employees of law enforcement agencies, that such crimes happen, and from there he intended to show employees the need for inclusion of hate crimes based on the phobia of LGBTI people in criminal law of Bulgaria. It also shows the need for a close and constant work with the police and law enforcement agencies in their work on the identification of crimes based on hate. The reported incidents occurred in 2017 “LGBT Youth Organization Action” is in the process of the development of the direct button on the website and communication channels, where injured parties may directly report accidents and crimes.

The report is printed on the Bulgarian and English and will be circulated to all State institutions, the Commission for protection against discrimination, NGOS, the police, prosecutors and other authorities dealing with criminal offences with a discriminatory motive.

KEY FINDINGS
The project was realized with the financial and methodological support of ILGA-Europe. It allow documentation of new incidents and future monitoring of hate crimes against LGBTI at national level. The report is printed on the Bulgarian and English and will be circulated to all State institutions, the Commission for protection against discrimination, NGOS, the police, prosecutors and other authorities dealing with criminal offences with a discriminatory motive.
In this connection, the data from the survey show that people in the LGBTI Bulgaria facing obstacles in the exercise of their fundamental rights.

Due to the lack of a legislative framework, however, and the fear of subsequent
secondary discrimination, many of the cases described in this report do not make it to the police, Prosecutor’s Office or court.

Many of the cases, shared with representatives of the “LGBT Youth Organization Action” are not even reported to the proper authority, no permission is given to the Organization to enter into this report.

NSI does not collect information about crimes with a discriminatory motive, sexual orientation, gender identity and/or expression of gender, because such crimes do not exist in the criminal code.

Homophobia is so far off from the list of crimes that are punished more severely because they are often fuelled by hatred. Currently, the law encourages attacking people with a different sexual orientation. At worst for attackers option act qualifies as a misdemeanor.
